The government has concluded that President Ram Baran Yadav's call to form a consensus government was against the spirit of the Interim Constitution.
A special cabinet meeting convened on Sunday agreed that it was unconstitutional for the president to write letter to the government.
"The steps taken by the president regarding the government, in the past and now, were against the spirit of the constitution," said Information Minister Raj Kishor Yadav after the meeting.
He said the president's office would be informed about the cabinet decision.
President Ram Baran Yadav on Friday called on the parties to pick a common candidate to lead a national consensus government within a week.
Earlier, the president had remarked that the current Baburam Bhattarai-led had automatically become a caretaker one after the dissolution of the Constituent Assembly (CA).
The president's statement was against the interim constitution as the current government was elected through legislative parliament and is continuation of the same, said the Information Minister.
"The president's doesn't have any executive power," said Yadav. "The president can only take a decision on the recommendation of Cabinet."
