Kathmandu,
Nov. 7: The Supreme Court has issued a directive order in the name of the
government for conducting the elections of local bodies at a suitable time.
A
division bench of Chief Justice Khilaraj Regmi and Justice Prakash Wasti today
issued an order to that end. "A
directive order has been issued for holding elections at an appropriate time by
making all necessary arrangements," the court order states.
It
may be noted that Madhav Poudel of the District Development Committee
Federation, Bidur Mainali of Nepal Municipalities' Association and lawyer Dr
Chandra Kanta Gyawali on behalf of Village Development Committee Federation,
had filed a writ petition at the apex court in February, demanding that local
bodies' election be held immediately.
"The
elections of local bodies cannot be held since 2056 BS and corruption and
irregularities have been rampant as the local bodies are being run through the
political mechanism", the petition says.
The
petition was filed on the basis of the amended Article (139) of the Interim
Constitution that clearly states that the election of the local bodies will be
conducted. Earlier also, advocate
Gyawali registered a writ petition at the court demanding the conduction of
local bodies' election and responding to the petition, the court had drawn the
government's attention to that end.
Advocate
Dr Gyawali said he had to file the petition on the same matter twice since the
government turned a deaf ear towards the SC's call and did not pay any heed to
hold the election.
With
today's decision of the Supreme Court, the government has been compelled to
hold the election, he added.
