Kathmandu,
Jan. 31: All tiers of courts will remain closed on February 2, Sunday, to mourn
the demise of former Chief Justice (CJ) Biswonath Upadhya.
The
full meeting of the Supreme Court chaired by acting Chief Justice, Damodar
Prasad Sharma, on Friday decided to shut all types of courts, Special Court and
tribunals across the country to mourn
the passing away of former CJ.
The
meeting has expressed grief over the irreparable loss incurred to the nation
from the demise of a true nationalist and democrat and accorded high respect to
Upadhya for his substantial contribution to consolidate independent judiciary
and rule of law in the country.
Upadhya,
who has been acclaimed as a noted legal drafter, constitutional law expert and
well-versed judicial personality, will be remembered forever for his qualities,
said the meeting.
Upadhyay
had served as Chief Justice for four years since 2048 BS to 2052 BS. Earlier he
discharged diverse responsibilities in the capacity of apex court justice and
chairman of Nepal Legal Reform Commission.
He
had also headed the drafting committee of the constitution of the Kingdom of
Nepal-2047 BS (1990 AD). Ex-CJ
Upadhaya, admitted to National Institute of Neurological
and Allied Sciences, Bansbari after brain hemorrhage on January 25, passed away
last night. He was 84.
Meanwhile,
Vice-president of Nepali Congress, Ram Chandra Paudel, expressed deep sorrow on
the demise of former CJ Upadhya and extended heartfelt condolence to the
bereaved family and his relatives.
Issuing
a condolence message on Friday, leader Paudel said the late Upadhyay was a
genuine justice, who had played crucial role towards consolidating independent
judiciary, democratic system and the
rule of law in the country.
